5. Services and Transactions
5.1. Description of the Services
CHAPP SOLUTIONS offers different solutions to optimise hotel management:
- LEAN Hotel System: Property Management System.
- POK: Optimisation of inputs and outputs.
- Housekeeping App: Application for the management of the housekeeping department.
- Front Desk App: Application to obtain the guest's signature in digital format.
5.2. Purchasing Process
Purchases or service contracts are made through the Site following the established process. By completing a purchase, you agree to pay the price indicated and comply with the payment conditions established.
5.3. Cancellation and Refund Policy
- Non-cancellation policy for signed contracts
Once the contract has been signed by both parties, cancellation is not possible. The customer undertakes to fulfil all obligations set out in the contract during the agreed period. Any request for cancellation will not be accepted, and the contract must be fulfilled in its entirety. - Penalty policy for cancellation of current contract
If a customer decides to cancel an existing contract, he shall pay a penalty equal to the total amount of the outstanding instalments due until the end of the contract. This penalty will be applied without exception and must be paid in full at the time of cancellation. - Contract termination policy for non-payment or improper use
In the event of non-payment or if use of the applications outside the scope of the assignment specified in the contract is detected, the provider shall be entitled to terminate the contract immediately. The customer shall have a period of 48 hours to pay the unpaid amounts of the overdue instalments before final termination of the contract. If payment is not made within this period, the contract shall be terminated without the right to reimbursement.
6. Limitation of Liability
To the maximum extent permitted by law, CHAPP SOLUTIONS shall not be liable for any indirect, incidental, special, consequential or punitive damages, including, without limitation, loss of profits, data, use, goodwill or other intangible losses, resulting from:
- Your access to or use of, or inability to access or use, the Site.
- Any conduct or content of third parties on the Site.
- Any content obtained from the Site.
7. Indemnification
You agree to indemnify and hold CHAPP SOLUTIONS, its affiliates, directors, employees and agents harmless from any claims, demands, damages, liabilities and costs (including reasonable attorneys' fees) arising out of your use of the Site, your violation of these Terms and Conditions, or your violation of any rights of any third party.
8. Modifications to the Terms and Conditions
CHAPP SOLUTIONS reserves the right to modify these Terms and Conditions at any time. Modifications will be effective immediately upon posting on the Site.
